Disability Leave

A. Definition

An illness, injury, or other medical condition which prevents you from performing your work duties for 15 consecutive days shall be considered “a disability” for purposes of this policy. “Onset of disability” means the first day you are unable to perform normal work duties as a result of your condition.

B. Eligibility

If you are eligible for the ELCA Medical and Dental benefits you are entitled to disability benefits. (See classification chart to determine if you are eligible.)

C. Disability Pay

Should you meet the definition of "disabled" you will receive paid sick leave until your accrued sick leave is exhausted. After exhaustion of accrued sick leave you will receive full salary, from the seminary, for a period not to exceed 60 working days as long as you still meet the definition of “disabled.” Disability pay will first be deducted from your accrued sick leave account until the account is exhausted. After 60 days you may qualify for longer term benefits under the ELCA Medical Plan if applicable. See the plan booklet provided by the ELCA for explanation of their benefits.

Disabilities relating to pregnancy and childbirth are covered by this policy to the same extent and under the same eligibility requirements as other disabilities. Thus, if you have exhausted your sick leave, you may take disability leave during pregnancy or following childbirth to the extent medically necessary, provided that you submit the required certification from your physician.

D. Family and Medical Leave Act

Disability leave will count toward the twelve weeks of leave that may be taken under the Family and Medical Leave Act.
